An Assignment is the deed which transfers an existing Lease (or Underlease) from the current Tenant to a new Tenant. It usually coincides with the sale of a leasehold business and allows the buyer to trade from the premises on the day he takes over the business.
We will prepare the deed which will include an obligation for the new Tenant to comply with all the obligations in the Lease, including payment of the rent.
As most Leases cannot be transferred from one Tenant to another without the landlord’s consent, we will gather together various documents and present a case to the landlord for giving consent to the transfer of the Lease.
When consent to the transfer of the Lease is given, it will be in the form of a Licence to Assign.
